The Supreme Court of India has clearly mentioned the difference between games whose result is dependant on luck or chance and those requiring specific skills. A game based upon skills; such as rummy, is not considered to be gambling. Most experts claim poker to be a skill game as well, rather than of mere luck. This is especially true because several state courts also found that the falling of cards in each round has an impact on the game. At a certain point of the game, you have to decide and think tactically.
Poker: A game of skill
Remembering each hand is a skill and poker needs that expertise very well. However, it is difficult for someone who hasn’t played the game to understand the fundamentals of the same. Poker is a type of card game which needs combined strategy, and skill. Although all poker games involve some betting; an unavoidable part of the play, it is not truly gambling. Determining the winner of each hand depending upon the combinations of a player's cards is not just luck. It involves too much of strategy building abilities. Depending upon this ability, you must keep account of all the cards, so that you may judge whether your opponent has kept any vital card hidden till the end of the game. Law confirms that poker is a game of skill
The High courts of Karnataka and Calcutta; in October 2013 and July 2015 respectively, have also opined Poker to be a game that needs specific skill sets. Hence, it is not gambling at all. Besides, playing online poker is legal throughout the country. This resonates the fact that it's a skill game.
